AGREEMENT

1. Fees, Charges, Billing. Dream Clean Maid Services LLC offers estimates for cleaning services based on: (1) the service requested by the client, (2) the total square-footage of the structure to be cleaned, (3) any requested additional services, and (4) the condition of the property the client is requesting to be cleaned. The condition of the property is provided by the client using a sliding “rating point” scale: 1 = extremely dirty, 5 = average, and 10 = spotless. The sliding scale is defined according to the terms and home rating scale and guide provided on the Dream Clean Maid Services LLC website which can be found at https://dreamcleanidaho.com/cleaning-tips/home-ratings-guide/ and which are incorporated in this Agreement as if fully set forth herein. The ratings guide and all other content on the website are subject to change at any time without notice. Dream Clean Maid Services LLC will then provide the Client with an estimate of the cost for requested services at the property. Any estimate is subject to change and is not binding upon Dream Clean Maid Services LLC. Client authorizes Dream Clean Maid Services LLC to utilize any billing and financial information provided by the Client to Dream Clean Maid Services LLC for purposes of collection of amounts owed. Within twenty-four (24) hours prior to provision of services, Client hereby authorizes Dream Clean Maid Services LLC to contact Client’s financial institution for purposes of verifying availability of funds, and pre-authorization of a charge in the amount of the estimate. Client likewise authorizes Dream Clean Maid Services LLC to utilize any and all financial information provided by Client to Dream Clean Maid Services LLC for purposes of withdrawal and transfer of funds to Dream Clean Maid Services LLC in an amount owed to Dream Clean Maid Services LLC, for any services provided, or in the amount of cancellation fees charged. Total funds withdrawn may exceed the estimate provided to the Client. When the Dream Clean Maid Services LLC staff arrive at the job location, on the scheduled date of cleaning, if the client underestimated the condition of the property the total amount charged will be more than the original estimate.  By scheduling Dream Clean Maid Services LLC services client agrees to pay the estimate amount, and any cancellation fees. All sums which are unpaid by the client for more than 30 days after services are rendered shall accrue interest at a rate of 15% per annum.
2. Clients agree, by booking recurring services with Dream Clean Maid Servics LLC, to maintain that frequency of service for a minimum of 6 cleanings to maintain their discounts.Should a client cancel their recurring services prior to the 6 scheduled and completed cleanings, they’ll be retroactively charged the difference between the one time cleaning and what recurring schedule that they had booked.This fee will not apply to any future canceled cleanings, but only to each completed cleaning leading to the 6th and final cleaning, per this agreement.
3. Client Agrees that Dream Clean Maid Services LLC shall, at the time of provision of services, perform an assessment of the premises to be cleaned, and if, in Dream Clean Maid Services LLC’s sole discretion, Dream Clean Maid Services LLC determines that Client has underestimated the condition of the property to be cleaned, Dream Clean Maid Services LLC may, without notice to the Client, provide cleaning services and then charge the client in amount equal to $120 per rating point below the Client’s estimate according to the rating scale and guide provided on the Dream Clean Maid Services LLC website. Dream Clean Maid Services LLC will not charge a client more than $1,500.00 in excess of the estimate amount without prior approval.
4. Client Agrees that, Dream Clean Maid Services LLC may charge Client a cancellation fee according to the following schedule if the appointment is cancelled less than 72 hours before the appointment time and date.
   1. For jobs estimates at $199 or less, there will be a $100 cancellation fee.
   2. For jobs estimated at $200 or more, there will be a cancellation fee equal to 50% of the estimate provided to the client.
5. The client must provide 72-hour notice to Dream Clean Maid Services LLC if any special, unique, unusual, cleaning methods or cleaning products must be used on delicate, fragile, antique, or sensitive items or surfaces. If no notice is provided by the client, and Dream Clean Maid Services LLC damages any delicate, fragile, antique, or sensitive surfaces in the normal course of their cleaning practices, the client agrees that Dream Clean Maid Services LLC will not be liable to replace or repair the damaged item or surface, and hereby releases any and all claims for damages and agrees to indemnify and defend Dream Clean Maid Services LLC against any claim for damages which may arise as a result of damage to property as provided in this Sentence.
6. Dream Clean Maid Services LLC does not offer a satisfaction guarantee. If the client is not satisfied with the service received, they must report the issue and provide photographic evidence to Dream Clean Maid Services LLC within 24 hours of the completion of the service. Dream Clean Maid Services LLC will then evaluate the property and the work performed and either correct the alleged deficiency, extend a credit on a future cleaning, apply a reasonable refund as determined appropriate by Dream Clean Maid Services LLC in its sole discretion, or uphold the quality of work provided and take no further action.

1. Limitation of Services. Dream Clean Maid Services LLC will not, under any circumstances: lift and move heavy furniture that requires two or more people to move, reach heights in excess of a two-step ladder, clean the front of TVs, clean carpets (beyond vacuum), clean bio-hazardous substances (i.e., feces, blood, etc.), clean infested properties (i.e., rodents, insects, mold etc.), move appliances that are connected to gas, electricity or water, clean custom light fixtures or chandeliers, dishes, laundry, inside China Cabinets, plant shelves or provide service clients who are, in Dream Clean Maid Services LLC’s sole discretion, disrespectful or offensive to Dream Clean Maid Services LLC staff.
2. Dream Clean Maid Services LLC offers an exhaustive list of services offered within the clients requested level of cleaning, and an exhaustive list of extra services available for an additional charge. Any services that are not included on the lists of services offered are unavailable, and will not be included in any scheduled services.
3. Limitation of Liability. In no event will Dream Clean Maid Services LLC be liable, whether in contract, warranty, tort (including negligence), products liability, strict liability, or other, to any person for any damages, including but not limited to, direct, indirect, incidental, special, exemplary, punitive, or consequential damages, arising out of or in connection with any cleaning services, and Client hereby specifically releases Dream Clean Maid Services LLC from the same, and agrees to indemnify and defend Dream Clean Maid Services LLC from any such claim which may arise. If an award of damages is deemed appropriate by the judiciary, the maximum damages to be paid by Dream Clean Maid Services LLC will be limited to the amount of the original estimate Dream Clean Maid Services LLC provided for the cleaning services.
4. You agree to indemnify, defend and hold harmless Dream Clean Maid Services LLC, its affiliates, shareholders, agents, licensors, and suppliers together with their officers, directors, owners, partners and employees, from and against all losses, expenses, damages and costs, including attorney’s fees, resulting from: (a) any violation of these Terms of Use, and (b) any damage resulting from cleaning services.
5. Client has been advised to seek the advice of legal counsel prior to scheduling Dream Clean Maid Services LLC services, and by proceeding with the scheduling of Dream Clean Maid Services LLC Services, the Client manifests that they:
   1. Have exercised or waived their right to seek the advice of legal counsel;
   2. Have read and understood the terms provided herein; and
   3. That they have the authority to contract Dream Clean Maid Services LLC for services upon the Property.
6. Dispute Resolution. Any claim brought against or by Dream Clean Maid Services LLC must be resolved in Arbitration by the American Arbitration Association, and under its rules and procedures.
7. This Contract shall be governed by Idaho Law.
8. Additional Terms. Dream Clean Maid Services LLC’s failure to enforce the Contract, or any provision herein, shall not be construed as a waiver of any provision or right. If any provision of the Terms of Use is unenforceable, the remaining provisions will be enforced to their fullest extent under Idaho law.

I, the Client, have read and understand this Contract. I have likewise been advised to seek legal counsel with respect to this Contract, and by booking of Dream Clean Maid Services LLC services, I do manifest that I have exercised or waived such right and agree to the legally binding terms and limitations of this Agreement.
